1. Acceptance of Terms
By accessing or using the EdenCare Support Services website at www.edencaredisability.org ("the Site") or engaging our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, please do not use our website or services.
2. About Our Services
EdenCare Support Services ("EdenCare", "we", "us", or "our") is a registered NDIS provider offering disability support, aged care, and allied health services in Melbourne, Australia. Our services include, but are not limited to:
- Personal care and daily living assistance
- Community access and social participation
- Nursing care
- Allied health services (physiotherapy, chiropractic care)
All services are delivered in accordance with relevant NDIS Practice Standards, the Aged Care Quality Standards, and applicable Australian legislation.
3. Eligibility
Our disability support services are available to participants with a valid NDIS plan. Aged care services are available to eligible individuals as assessed by the relevant Commonwealth assessment bodies. Allied health services are available to the general public.
4. Service Agreements
Where we provide care and support services, a separate Service Agreement will be entered into between EdenCare and the participant (or their authorised representative). That agreement will detail the specific services, schedules, fees, and responsibilities of both parties. In the event of any inconsistency, the Service Agreement takes precedence over these Terms.
5. Use of the Website
You agree to use the Site only for lawful purposes. You must not:
- Use the Site in any way that breaches applicable local, state, or Commonwealth law
- Attempt to gain unauthorised access to any part of the Site, its servers, or connected systems
- Transmit any material that is defamatory, offensive, or otherwise objectionable
- Introduce viruses, malware, or other harmful code to the Site
- Scrape, data-mine, or reproduce content from the Site without our written consent
6. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of EdenCare Support Services or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written permission.
7. Referrals and Enquiries
Information submitted through our referral and contact forms is used solely for the purpose of responding to your enquiry or processing your referral. By submitting a form, you confirm that the information provided is accurate and, where applicable, that you have the consent of the person being referred.
8. Fees and Payment
Service fees are outlined in individual Service Agreements and are charged in accordance with the relevant NDIS Price Guide, aged care fee schedules, or our private fee schedule for allied health services. We reserve the right to update fees in line with regulatory changes, with reasonable notice provided to affected participants.
9. Cancellations
Cancellation policies for scheduled services are detailed in your individual Service Agreement. In general, we request reasonable notice for cancellations. Short-notice cancellations or no-shows may incur charges as permitted under NDIS or aged care pricing rules.
10. Limitation of Liability
To the maximum extent permitted by law, EdenCare shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services. This includes, but is not limited to, loss of data, loss of revenue, or service interruptions.
Nothing in these Terms excludes or limits any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law.
11. Disclaimer
The information provided on the Site is for general informational purposes only and does not constitute medical, health, or professional advice. While we endeavour to keep the content accurate and up to date, we make no warranties or representations regarding its completeness, accuracy, or reliability.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

We may revise these Terms at any time by updating this page. Continued use of the Site following any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
